Makent Cars rider Refund Policy
These terms and conditions govern Makent Cars’s policy for rider refunds and the obligations of the Owner associated with the rider Refund Policy, that applies in addition to Makent Cars’s Terms of Service. The rider Refund Policy is available to riders who book and pay for a travel through the Makent Cars Platform and suffer a Travel Issue. The rider’s rights under this rider Refund Policy will supersede the Owner’s cancellation policy.
All capitalized terms shall have the meaning set forth in the Makent Cars Terms or Payments Terms unless otherwise defined in this rider Refund Policy. By using the Makent Cars Platform as an Owner or rider, you are indicating that you have read and that you understand and agree to be bound by this rider Refund Policy.
1. Travel Issue
Only a rider may submit a claim for a Travel Issue. If you are a rider, in order to submit a valid claim for a Travel Issue and receive the benefits with respect to your reservation, you are required to meet each of the following conditions:
(i) You must bring the Travel Issue to our attention through mail by sales@trioangle.com with information (including photographs or other evidence) about the car and the circumstances of the Travel Issue within 24 hours after the start of your reservation, and must respond to any requests by us for additional information or cooperation on the Travel Issue.
(ii) You must not have directly or indirectly caused the Travel Issue (through your action, omission or negligence).
(iii) You must have used reasonable efforts to try to remedy the circumstances of the Travel Issue with the Owner prior to making a claim for a Travel Issue.
2. The rider Refund Policy
If you are a rider and suffer a Travel Issue, we agree, at our discretion, to either reimburse you up to the amount paid by you through the Makent Cars Platform depending on the nature of the Travel Issue suffered, or use our reasonable efforts to find and book you another alternate cars in case of any issue.
3. Minimum Quality Standards, Owner Responsibilities and Reimbursement to rider
3.1 If you are an Owner, you are responsible for ensuring that the car you list on the Makent Cars Platform meet minimum quality standards regarding access, adequacy of the Listing description, safety, cleanliness, and do not present a rider with Travel Issues.
3.2 If you are an Owner, and if (i) Makent Cars determines that a rider has suffered a Travel Issue related to the car listed by you and (ii) Makent Cars either reimburses that rider or provides an alternative car to the rider, you agree to reimburse Makent Cars up to the amount paid by Makent Cars within 30 days of Makent Cars’s request. If the rider is altered to an alternative car, you also agree to reimburse Makent Cars for reasonable additional costs..
3.3 As an Owner, you understand that the rights of riders under this rider Refund Policy will supersede your selected cancellation policy. If you dispute the Travel Issue, you may notify Makent Cars regarding it, you must have used reasonable and good faith efforts to try to remedy the Travel Issue with the rider prior to disputing the Travel Issue claim.
4. General Provisions
4.1 Modification or Termination - Makent Cars reserves the right to modify or terminate this rider Refund Policy, at any time, in its sole discretion, without prior notice. If Makent Cars modifies this rider Refund Policy, we will post the modification on the site or provide you with notice of the modification also process all claims for Travel Issues made prior to the effective date of the modifications.
4.2 Entire Agreement - This rider Refund Policy constitutes the entire and exclusive and understanding and agreement between Makent Cars and you regarding and the rider Refund policy and Supersedes and replaces any and all prior oral or written understandings or agreements between Makent Cars and you regarding the rider Refund Policy.
